Conditions of Carriage


General Conditions


1.1. As used in this contract “Ticket” shall be understood to include your E-Ticket Customer
Receipt and all documentation issued to you as part of your E-Ticket (of which these conditions
and the notices form part) for carriage on a carrier, “carriage” is equivalent to “transportation”,
“carrier” means GUM AIR N.V. and includes where the context so admits all air carriers
contracted or chartered by GUM AIR N.V. to carry the passenger or his baggage or perform any
other service incidental to such air carriage. “Warsaw Convention” means the Convention for the
Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12th
October 1929, as amended, “Passenger” means any individual in whose name a ticket has been
issued.

1.2. Carriage is subject to the rules and limitations relating to liability established by the Warsaw
Convention unless such carriage is not “International carriage” as defined by that Convention.

1.3. To the extent not in conflict with the foregoing, carriage and other services performed by
each carrier are subject to:

  • provisions contained in the ticket;
  • applicable International Conventions and tariffs;
  • carrier’s conditions of carriage and related regulations;
  • any written or oral directions to the extent not inconsistent with the ticket and carrier’s conditions of carriage.
 1.4. Carrier’s name may be abbreviated in the ticket, agreed stopping places are those places set
forth in this ticket or as shown in carrier’s timetables as scheduled stopping places on the
passenger’s route; carriage to be performed hereunder by several successive carriers is regarded
as a single operation.

1.5. An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as
its Agent

1.6. Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents,
servants and representatives of carrier and any person whose aircraft is used by carrier for
carriage and its agents, servants and representatives.

1.7. This Ticket is not transferable and confers a contractual right to carriage on the Passenger
only. There is no obligation to provide any transport or services under this Ticket unless
satisfactory proof of identity is produced (namely a passport) by the Passenger when checking in
to board a flight.

1.8. If Passenger alters or cancels transport or for any reason does not use the Ticket for the
contracted carriage, GUM AIR N.V. may charge cancellation fees or make full or partial refunds
in its absolute discretion. Not all services or fare types are necessarily available to all passengers.

1.9. Purchaser of the Ticket acknowledges receipt of this Ticket for related charges described
therein. If this Ticket is purchased with a credit card, Purchaser agrees to make payment in full
when billed or in extended payments in accordance with the standard policy of the issuer of the
credit card.

1.10. GUM AIR N.V. may, without notice, carry out its contractual obligations of carriage through
the agency of a carrier. These Terms apply to any substituted or altered transport or services.

1.11. Except as otherwise provided by these Terms, and to the extent permitted by law:
a. Carriers are not liable for death of or injury to Passenger or any person, for loss of or damage
to baggage or goods, for delay, or for consequential or other loss of any kind, arising directly or
indirectly from negligence or omission or other cause, in connection with provision or non provision 
of any transportation or service: and
b. GUM AIR N.V. shall not be liable for inaccuracy in any information concerning transportation,
services or their pricing.

1.12. Any liability of GUM AIR N.V. to a Passenger for breach of any provision of or term and any
liability of a carrier in negligence shall not exceed the cost of the Passenger’s ticket.

1.13. Protection given by these Terms to a Carrier shall extend to its servants, agents,
representatives, related companies and independent contractors. This condition is included for
the protection of those persons, in consideration of their services to the Passenger.

1.14. If any term fails to have all, some or any effect, or causes any other term to fail to have any
effect, it shall be read down or severed to preserve the rest of these Terms.

1.15. Wherever it is issued, this Ticket and carriage or services supplied there-under are governed
by the laws for the time being in force in Suriname
